These terms are an agreement between Assisto AI ("Assisto", "we", "us") and the business that signs up for Assisto ("you", "the Shop"). By creating an account or using the service, you agree to them. If you're signing up on behalf of a business, you confirm you're allowed to accept these terms for it.
1. The service
Assisto is an AI receptionist for appointment-based businesses. It answers customers on WhatsApp, SMS and (on eligible plans) phone calls, checks your availability, books, reschedules and cancels appointments in your calendar, sends booking-related messages, and gives you a dashboard of your bookings. Features may change as we improve the service; we'll tell you before removing a feature your plan depends on.
2. Your account
- You must be at least 18 and use Assisto for a business.
- Keep your login details secure and the information in your account (services, prices, hours, address) accurate — Assisto uses it to answer your customers.
- You're responsible for activity under your account. Tell us right away at support@getassisto.com if you think it has been accessed without permission.
3. Free trial, plans and billing
- New accounts get a 14-day free trial. No card is required for the trial, and you won't be charged unless you choose a paid plan.
- If you don't subscribe by the end of the trial, your AI receptionist is paused. You can reactivate any time.
- Paid plans are billed in advance, monthly or yearly, in Canadian dollars, plus applicable taxes, through our payment processor Stripe. Plans renew automatically until cancelled.
- You can cancel any time. Cancellation takes effect at the end of the current billing period, and we don't give refunds for partial periods unless required by law.
- If a payment fails, we'll let you know. If it isn't resolved, we may pause the service.
- We may change prices with at least 30 days' notice. New prices apply from your next renewal after the notice period.
4. Your responsibilities when messaging customers
- Share your Assisto number only with people who may want to contact your business, and only use Assisto for appointment-related communication.
- Follow the law and the platforms' rules, including Canada's anti-spam legislation (CASL), privacy laws, and WhatsApp's Business and Commerce policies.
- Don't use Assisto to send spam, unlawful, harmful, misleading or adult content, or to impersonate anyone.
- Respect customers who opt out. Customers can reply STOP to stop receiving messages.
We may suspend accounts that break these rules or put our phone numbers or messaging access at risk.
5. AI limitations
Assisto uses artificial intelligence. It's designed to follow your hours, services and availability, but it can occasionally misunderstand a message or make a mistake. Review your calendar and dashboard regularly. Assisto doesn't give medical, legal or other professional advice, and you remain responsible for your business's dealings with your customers.
6. Your data
You own the information you and your customers provide through Assisto, including your customer list and booking history. You give us permission to use it only to provide, secure and improve the service, as described in our Privacy Policy. You're responsible for having the right to share your customers' information with us for this purpose. We never sell your data.
7. Phone numbers
We provide your shop's Assisto booking number for use with the service. The number remains ours (or our provider's). If your account is cancelled or paused for an extended period, we may release the number. We'll give you notice before doing so where we reasonably can.
8. Third-party services
Assisto relies on third-party services such as WhatsApp, Twilio, Google Calendar, Anthropic and Stripe. Their availability and rules can change, and we're not responsible for outages or decisions made by those providers, though we'll do our best to keep you informed and minimize disruption.
9. Availability
We work to keep Assisto running 24/7, but we don't guarantee it will be uninterrupted or error-free. We may carry out maintenance, ideally outside busy hours.
10. Our property
Assisto, our website, software and brand belong to us. You may not copy, resell, reverse-engineer or misuse the service.
11. Disclaimer
Except as stated in these terms, Assisto is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including lost bookings, lost profits or lost data. Our total liability for any claim relating to Assisto is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
You agree to cover our reasonable losses arising from your breach of these terms, your misuse of the service, or your messages to customers.
14. Ending the agreement
You can stop using Assisto and cancel at any time. We may suspend or end your account if you seriously or repeatedly break these terms, or if required by law or by our providers. On termination, we handle your data as described in our Privacy Policy.
15. Changes to these terms
We may update these terms. We'll post the new version here and email you about significant changes at least 15 days before they take effect. Continuing to use Assisto after that means you accept the updated terms.
16. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario.
